Amendment Explained

Be it enacted by the people of South Dakota

That Article VI of the Constitution of the State of South Dakota be amended by adding a NEW SECTION:

Before the end of the first trimester, the State may not regulate a pregnant woman’s abortion decision and its effectuation, which must be left to the judgement of the pregnant woman.

After the end of the first trimester and until the end of the second trimester, the State may regulate the pregnant woman’s abortion decision and its effectuation only in ways that are reasonably related to the physical health of the pregnant woman.

After the end of the second trimester, the State may regulate or prohibit abortion, except when abortion is necessary, in the medical judgment of the woman’s physician, to preserve the life or health of the pregnant woman.

Why Fight Amendment G?

This isn’t a debate about whether you support the current law prohibiting abortions, except when the mother’s life is at risk, or prefer exceptions for rape and incest. The real issue is whether you oppose the idea of aborting healthy, full-term, 39-week-old babies and whether, as a parent, you want legal rights if your underage daughter is considering an abortion. Amendment G would make both of these extreme scenarios possible.

Now, assuming you agree with this perspective, the logical next question is: Does investing in defeating Amendment G make a tangible difference in protecting life?

In 2023, South Dakota recorded zero abortions. In 2021, the last full year before Roe v. Wade was overturned, there were 192 abortions in the state. Because Amendment G allows for abortions at any stage of pregnancy, we believe these numbers could dramatically increase. Over the past 25 years, South Dakota has averaged 590 abortion fatalities per year, with about 3% involving underage mothers.

We believe that passing Amendment G would lead to a significant rise in abortion rates, surpassing the long-term average. So, is saving the lives of 590 or more unborn babies each year worth the investment? We think so.
